Terms of Service

Welcome to Rentablez. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and Rentablez ("Company", "we", "us", or "our") governing your access to and use of the Rentablez platform, website, mobile applications, and related services (collectively, the "Service").

Please read these Terms carefully before accessing or using our Service. By accessing or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any provision of these Terms, you must immediately discontinue use of the Service.

1. Service Description and Platform Relationship

Rentablez operates as an online marketplace platform that facilitates rental transactions between independent parties. Specifically:

• The Service enables item owners ("Lessors") to list products, equipment, and other rentable items for temporary use
• The Service enables renters ("Lessees") to discover, reserve, and rent items from Lessors
• Rentablez acts solely as an intermediary platform and is not a party to the actual rental agreements between Lessors and Lessees
• All rental transactions are concluded directly between Users, and Rentablez bears no responsibility for the performance, quality, condition, or legality of listed items or the conduct of Users

Users acknowledge and agree that Rentablez does not take possession of, verify, or inspect listed items and makes no representations or warranties regarding any items listed on the platform.

2. Eligibility and Account Registration

2.1 Age Requirements: You must be at least eighteen (18) years of age to create an account and use the Service. Users under 18 may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Account Information: During registration, you must provide accurate, current, and complete information. You agree to promptly update your account information to maintain its accuracy. Providing false, misleading, or fraudulent information constitutes a material breach of these Terms and may result in immediate account termination.

2.3 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to immediately notify us of any unauthorized access or security breach. Rentablez shall not be liable for any losses arising from unauthorized use of your account.

2.4 Account Suspension: We reserve the right to suspend or terminate any account, at our sole discretion, for violation of these Terms or any applicable laws, or for conduct that we determine to be harmful to other Users or to the integrity of the Service.

3. User Obligations and Conduct

3.1 Lawful Use: You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service in any manner that violates any applicable federal, state, local, or international law or regulation.

3.2 Listing Accuracy: Lessors warrant that all item listings contain accurate, truthful, and complete information, including descriptions, photographs, availability, pricing, and item condition. Listings must not contain false, misleading, or deceptive statements.

3.3 Rental Obligations: Lessees agree to use rented items in accordance with their intended purpose, exercise reasonable care, and return items in the same condition as received, subject to ordinary wear and tear. Any damage beyond ordinary wear and tear may result in charges for repair or replacement.

3.4 Prohibited Items: The following items are strictly prohibited from listing or rental:

• Illegal substances, weapons, or contraband
• Stolen property or items obtained through illegal means
• Items that violate intellectual property rights, including counterfeit goods
• Hazardous materials or unsafe items that pose health or safety risks
• Items whose rental would violate any applicable law or regulation

3.5 Prohibited Conduct: Users shall not engage in harassment, threats, defamation, or abusive behavior toward other Users; attempt to manipulate pricing or ratings; circumvent platform fees; or interfere with the proper functioning of the Service.

4. Payment Terms and Financial Obligations

4.1 Payment Processing: All financial transactions are processed through secure third-party payment service providers. By using the Service, you agree to comply with the terms and conditions of our payment processors.

4.2 Rental Fees: Rental fees are determined by Lessors and clearly displayed prior to transaction confirmation. By confirming a rental, Lessees agree to pay all applicable rental fees, service charges, taxes, and any additional charges disclosed at the time of booking.

4.3 Security Deposits: Certain rentals may require refundable security deposits to protect against damage or loss. Security deposit amounts, terms, and refund conditions are specified in the individual rental agreement.

4.4 Service Fees: Rentablez may charge service fees to facilitate transactions. All applicable fees are disclosed prior to transaction completion. Service fees are non-refundable except as expressly provided in these Terms.

4.5 Refunds and Cancellations: Cancellation and refund policies are determined by individual Lessors and are displayed in rental listings. Rentablez does not guarantee refunds for cancelled rentals but will facilitate dispute resolution between parties in accordance with the applicable cancellation policy.

5. Intellectual Property Rights

5.1 Platform Ownership: The Service, including all software, code, design elements, trademarks, logos, and content (excluding User-generated content), is the exclusive property of Rentablez and is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License: Subject to your compliance with these Terms, Rentablez grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include any right to: (a) resell or make commercial use of the Service; (b) modify, reverse engineer, or create derivative works based on the Service; (c) use data mining, scraping, or similar automated data gathering tools; or (d) remove any proprietary notices or labels.

5.3 User Content License: By posting content on the Service (including photographs, descriptions, and reviews), you grant Rentablez a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute such content in connection with operating and promoting the Service.

6. Disclaimers and Limitation of Liability

6.1 No Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. RENTABLEZ MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF THE SERVICE.

6.2 Platform Limitation: Rentablez does not warrant or guarantee: (a) the accuracy, legality, or quality of item listings; (b) the performance or conduct of Users; (c) that items will be as described or fit for a particular purpose; (d) the availability or uninterrupted access to the Service; or (e) that the Service will be error-free or secure.

6.3 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RENTABLEZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY; (c) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (d) ANY MATTER RELATING TO THE SERVICE.

6.4 Liability Cap: IN NO EVENT SHALL RENTABLEZ'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO RENTABLEZ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

6.5 User Responsibility: Users acknowledge that rental transactions are concluded at their own risk and discretion. Users are solely responsible for evaluating the suitability, safety, and legality of items and for conducting appropriate due diligence before entering into rental agreements.

7. Indemnification

You agree to defend, indemnify, and hold harmless Rentablez, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of or inability to use the Service; (b) your violation of these Terms; (c) your violation of any rights of another party, including other Users; (d) your violation of any applicable laws or regulations; or (e) any content you post or transmit through the Service. This indemnification obligation survives termination of these Terms and your use of the Service.

8. Dispute Resolution and Governing Law

8.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Rentablez is registered, without regard to its conflict of law provisions.

8.2 Informal Dispute Resolution: Prior to initiating formal proceedings, parties agree to attempt to resolve disputes through good faith negotiation for a period of thirty (30) days.

8.3 Jurisdiction: You agree to submit to the personal and exclusive jurisdiction of the courts located within the jurisdiction of Rentablez's principal place of business for the resolution of any disputes.

9. Modifications to Terms

Rentablez reserves the right to modify, amend, or update these Terms at any time at its sole discretion. Material changes will be notified through the Service or via email to registered Users. Your continued use of the Service following notification of changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically. The "Effective Date" at the top of this document indicates when these Terms were last revised.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for conduct that we believe violates these Terms, is harmful to other Users, or is otherwise detrimental to the interests of Rentablez. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

11. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Rentablez's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

12. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by Rentablez on the Service, constitute the entire agreement between you and Rentablez concerning the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Rentablez.
